Writing Contest Official Rules

The Sponsor’s computer is the official time-keeping device for the Writing Contest. A fee is not required to enter the Writing Contest.

 

All Initial Manuscript Submissions must be received only as directed by 5:00 PM EDT on June 8, 2018 (each an “Entry”). Submissions will only be accepted online as directed in these Official Rules. By entering the Writing Contest, entrants agree to be bound by these Official Rules. In the event of a dispute regarding any aspect of the Writing Contest, the Sponsor will make the final ruling in its sole discretion. Such ruling shall be final and binding, and no communication or correspondence will be exchanged with entrants regarding such ruling(s) unless otherwise required by law.

 

Submission Requirements: In order to be eligible, initial entries must meet the following requirements (collectively, the “Submission Requirements”):

Run an established blog (i.e. a blog was not established solely to enter the competition)

The submission must be at least 500 words

A backlink to www.clarahealth.com must be included in the post.

The following key words/phrases must be included in the post: Patients Have Power, clinical trial(s), research and/or breakthrough research, treatment

Each submission should include a URL to the post on writer’s blog along with blogger’s name and contact info.

Each Submission shall be in English.

 

By participating in the Writing Contest, each entrant represents and warrants that: (i) the Submission is original to the entrant, and all right, title and interest (including but not limited to copyright) therein and thereto is exclusively owned and/or controlled by the entrant to the full extent necessary to enable the Sponsor to use the Submission as contemplated by these Official Rules; (ii) the Submission does not contain any material that is libelous, defamatory, profane or obscene, as determined by the Sponsor in its sole discretion; (iii) the Submission does not contain any material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; (iv) the Submission does not contain any material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the Submission is created; (v) the Submission does not infringe upon the intellectual property or other statutory or common law rights of any third party (including but not limited to copyright, trademark, personality or privacy rights); (vi) the Sponsor’s and Administrator’s use and re-use of the Submission in accordance with the terms set out herein will not infringe or violate the rights of any third party (including copyright), or require any payment to or consent/permission from any third party; and (vii) the Submission has not been previously exploited or published in any form, excluding Self-Published Works, and no rights in or to the Submission have been granted, pledged, or assigned to any third party which would interfere with or derogate from the rights granted to the Sponsor and/or Administrator hereunder.

 

Eligibility: The Writing Contest is open only to legal residents worldwide. The following individuals are not eligible to participate in the Writing Contest: (i) employees of the Sponsor or Administrator (ii) Immediate Family members of the Sponsor or Administrator

 

For the purpose of these Official Rules, the term “Immediate Family” shall mean husband, wife, spouse, mother, father, brother, sister, son and/or daughter, whether or not they reside in the same household.

 

The Sponsor reserves the right, in its sole discretion, to immediately disqualify, without notice, any and all Submissions that do not comply with the Submission Requirements set out above, as determined in the Sponsor’s sole discretion. No communication or correspondence will be exchanged with entrants except with the entrants selected for a prize.

 

Submissions shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry (i.e., the natural person who is assigned to an e-mail address by an Internet service provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address). A potential winner may be required to provide the Sponsor with proof that she/he is the authorized account holder of the e-mail address associated with the potential winning Submission.

 

Prizes: One (1) grand prize, (1) second place prize, and (1) third place prize will be awarded and is dependent on the number of entries.

● If there are 10 eligible submissions, the grand prize will be $1,000, second place will be $250 and third place will be $100.

● For every 10 additional entries (up to 100), another $1000 will be added to the grand prize pool. The second place will be 25% of the grand prize, and the third place prize will be 10% of the grand prize. For example:

● If there are 20 eligible submissions, the grand prize will be $2,000, second place will be $500 and third place will be $200 and so on

● If 100 or more entries are received, the grand prize will be $10,000, second place will be $2,500 and third place will be $1000. (the “prizes”).

 

The prizes must be accepted as awarded and cannot be transferred, assigned, or substituted except at the sole discretion of the Sponsor. The winning entrant is solely responsible for any and all costs associated with claiming a prize. The outcome of the Writing Contest is dependent on the total number of eligible entries received, the quality of each Submission, the entrant’s skill and the Judges’ application of the Judging Criteria (as described below).

 

Winner Selection: The winner will be determined through the following process:

Initial Submission Phase: During the Initial Submission Phase, which ends on June 8, 2018, entrants will upload their eligible Initial Submission to https://pages.clarahealth.com/php-writing-contest.

First Round Judging: During the First Round of judging, all eligible submissions will be reviewed and assessed by Team Clara and up to 20 submissions will be chosen to move to the final round. The 20 finalists will be announced 1-2 weeks after June 8, 2018.

Final Round judging: The 20 submissions chosen as finalists will be reviewed by a panel of four judges chosen by the Sponsor in its sole discretion (which will include at least two (2) judges who are independent of the Sponsor).

 

Decisions of the Judges are final and binding in all respects.

 

Winner Notification: Winners will be notified by the end of June 2018 by the Sponsor via telephone or e-mail using the information provided by the entrant at the time of entry.

In the event that a potential winner: (i) fails to respond within tthree weeks the potential winner will be disqualified and an alternate potential winner will be selected by a process determined by the Sponsor in its sole discretion.

 

Notification of potential winners is deemed to have taken place at the time the Sponsor contacts a potential winner, either by telephone or by e-mail, at the telephone number or e-mail address provided by the potential winner at the time of entry or submission. Upon Grand Prize winner confirmation, the Grand Prize winner will be required to provide to the Sponsor a photo of the Grand Prize winner which may be used by the Sponsor, Administrator, and their respective parent companies, affiliates and/or subsidiaries for publicity and promotional purposes relating to the Writing Contest and the Sponsor’s related Patients Have Power program in any and all media now known or hereafter devised, without further compensation unless prohibited by law.

 

The Grand Prize winner will be announced on at [https://pages.clarahealth.com/php-writing-contest] (the “Contest Website”) on or about the end of June 2018.

 

Conditions: All federal, state, provincial, territorial and local laws and regulations apply, and the Contest is void where prohibited by law. Nothing contained herein shall constitute this Contest to be an arrangement for employment, a joint venture, or a partnership. In no way is a participant to be construed as the agent or to be acting as the agent of Sponsor or Administrator in any respect. Neither the Sponsor, Administrator, nor their respective parent companies, affiliates and/or subsidiaries, are responsible for printing, clerical or typographical errors of any kind or nature relating to entries. In no event will the Sponsor be obligated to award more than the stated number of prizes.

 

Disclaimers and Limit of Liability. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages, loss of data, income or profit, loss of damage to property, and claims of third parties. Sponsor makes no representation or warranties of any kind, express or implied, regarding any prize or entrant’s participation in the Contest. Sponsor, Administrator, and their respective parent companies, subsidiaries, affiliates, agents and promotional agencies (“Contest Entities”) shall not be responsible or liable for any loss, damage, cost, or injury that arises from or relates to participation in the Contest, or winning or use of a prize, including but not limited to: (a) late, lost, delayed, damaged, misdirected, incomplete, or unintelligible entries; (b) telephone, electronic hardware or software program, network, internet, or computer malfunctions, failures, viruses or difficulties of any kind; (c) failed, incomplete, garbled or delayed computer transmissions; (d) the uploading or downloading of any material in connection with the Contest; and (e) any other condition that may cause the Contest to be disrupted or corrupted, including, without limitation, any error or problem that may occur in connection with the administration of this Contest, the processing of entries, the announcement of prizes, or in any Contest -related materials. Sponsor reserves the right, in its sole discretion and without prior notice, to suspend or cancel any Contest or alter these Rules for any reason, including but not limited to, reasons of alteration or corruption of the administration of the Contest by computer virus, technical problem, or other unforeseeable event. Entries that have been tampered with or altered are void. This Contest is void where prohibited or otherwise restricted by law. Entrants are responsible for all costs associated with participation in the Writing Contest, including but not limited to computer equipment and internet connection charges. Neither the Sponsor, Administrator, nor their respective parent companies, affiliates and/or subsidiaries are responsible for damage to any participant’s computer system/software related to or resulting from participation or downloading any materials in connection with the Writing Contest.

 

Release Warranty and Indemnity. Entrants warrant that (a) your entry is your own original work and, as such, you are the sole and exclusive owner and rights holder of the submitted entry and that you have the right to submit the entry in the Contest and grant all required licenses; (b) any such entry will not, in Sponsor’s sole discretion, infringe or violate any copyright, trademark, trade secret, trade dress, patent or right of publicity or privacy, or misappropriate any proprietary right, of any third party; (c) any such entry is not the subject of any actual or threatened litigation or claim; (d) any such entry will not disparage Sponsor, its products and/or services or any other person or entity; and (e) no entry materials are defamatory, obscene, offensive, libelous, violent, pornographic, threatening, abusive, contain any illegal content, constitute or encourage a criminal offense, or would otherwise give rise to liability or violate any law or depict anyone engaged in any illegal, immoral or lewd act, or is otherwise objectionable as determined by Sponsor. Sponsor reserves the right, at its sole discretion, to remove any Entry that the Sponsor feels is inappropriate, objectionable and/or inconsistent with the positive image and/or good will it wishes to create through this Contest. To the maximum extent permitted by law, you (or your parent or legal guardian if an eligible minor) agree to release, defend, indemnify and hold harmless Sponsor, its affiliates and the Contest Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs, claims and expenses, including but not limited to, personal injury, death, damage to or loss of property, rights of publicity, privacy or defamation and attorneys’ fees,) arising out of or accruing from: (i) any Entry or other material uploaded or otherwise provided by you that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy; (ii) any misrepresentation made by you in connection with the Contest; (iii) any non-compliance or breach by you of these Rules and the representations and warranties set forth herein; (iv) claims brought by persons or entities other than the parties to these Rules arising from or related to your involvement with the Contest; (v) acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in the Contest; (vi) any error in the collection, processing, or retention of entry information in relation to the Entry and your participation in the Contest; or (vii) any typographical or other error in the printing, offering or announcement of any prize or winners in relation to your entry and participation in the Contest. The Contest Entities assume no responsibility for undelivered or undeliverable e-mails resulting from any form of active or passive e-mail filtering by an entrant’s Internet service provider and/or e-mail client or for insufficient space in entrant’s e-mail account to receive e-mail. The Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Writing Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE WRITING CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. The Writing Contest and these Official Rules are void, in whole or part, where prohibited by law and is subject to all applicable laws and regulations.

 

Taxes. The value of the prize will be taxable to the winner as income. All federal, provincial, territorial, state and local taxes and any other costs and expenses associated with the acceptance and/or use of prizes not specifically provided for in these Rules are solely the winner’s responsibility. Winner is solely responsible for reporting and paying any and all applicable taxes. United States residents will have income reported to them on IRS Form 1099, as required under IRS rules and a copy of said form will be sent to the IRS. Please contact your own tax advisor for any questions concerning taxes. 

 

Privacy and Use of Personal Information: By participating in the Writing Contest, each entrant grants to the Sponsor and Administrator, and their respective parent companies, affiliates and/or subsidiaries, the right to use his/her name, mailing address, telephone number, and e-mail address (collectively, “Personal Information”) as follows: (i) for the purpose of administering the Writing Contest, including but not limited to contacting and announcing the winners; (ii) for publicity and promotional purposes relating to the Writing Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law, such use shall only be with respect to the entrant’s name, city and country, state, province or territory of residence; and (iii) for the purpose of contacting an entrant with respect to the submission of additional literary works unrelated to the Writing Contest, at the Sponsor’s sole discretion. In addition to the foregoing, the prize winners acknowledges and agree that a photo of the prize winner (which shall be submitted by the prize winner to the Sponsor upon winner confirmation) may be used by the Sponsor, Administrator, and their respective parent companies, affiliates and/or subsidiaries for publicity and promotional purposes relating to the Writing Contest and the Patients Have Power program, in any and all media now known or hereafter devised, without further compensation unless prohibited by law. The Sponsor and Administrator, and their respective affiliates and/or subsidiaries will use the entrant’s Personal Information only for identified purposes, and will protect the entrant’s Personal Information in a manner that is consistent with the Sponsor’s and Administrator’s respective privacy policies. Termination: Subject to any governmental approval which may be required, the Sponsor reserves the right to terminate or suspend the Writing Contest, in whole or in part, and/or amend the Official Rules in any way, at any time, for any reason, without prior notice. In the event that the Writing Contest is terminated or suspended, the Sponsor will select a potential winner from all eligible, non-suspect Submissions received prior to such action.

 

Amendments to Official Rules: Any amendments to the Official Rules will become binding upon all entrants at the time they are posted to the Contest Website. Entrants are advised to regularly check the Contest Website for updates, notices and revisions to the Official Rules during the Contest Period.

 

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsor or Administrator in connection with the Writing Contest, shall be governed by, and construed in accordance with, the laws of California.

 

Winners List: The winner’s name and country of residence will be posted to the Contest Website towards the end of June 2018 and will be available for viewing for at least one (1) month thereafter.
